Terms of Service

1. Acceptance of these terms

These working draft terms describe proposed conditions for using PerkTrek, operated by PerkTrek LLC in Texas. The terms are not approved or effective until reviewed and adopted by PerkTrek. The intended account flow asks users to acknowledge these terms before requesting an authentication link; the application does not currently record that acknowledgment as a separate consent record.

2. Eligibility

PerkTrek is for people who are at least 18 years old. The service requests an age acknowledgment and does not ask for a date of birth. That acknowledgment is not independent age verification.

3. Account registration and authentication

An email address is required to request a sign-in link. PerkTrek uses email-based magic-link authentication through Supabase Auth. The current flow can create accounts and sign in existing users and does not provide a password-based login. Keep access to your email account secure and contact PerkTrek if you believe your account has been used without authorization.

4. The PerkTrek service

PerkTrek provides a platform for discovering participating locations, recording check-ins, tracking trail and passport participation, and presenting reward opportunities supplied by participating businesses. Features and locations may change. PerkTrek does not guarantee uninterrupted access or that a particular trail, location, or reward will remain available.

5. Your responsibilities and acceptable use

You agree to use PerkTrek honestly and lawfully. You must not:

• misrepresent a visit or attempt to obtain stamps or rewards through deception;
• interfere with the service, its security, or another person's account;
• attempt to access data, accounts, or systems you are not authorized to use; or
• use PerkTrek in a way that violates applicable law or another person's rights.

6. Check-ins and stamps

A check-in is intended to represent an eligible visit to a participating location using the PerkTrek check-in method. The intended program rule is no more than one eligible stamp per location in a 24-hour period. The current implementation has not been verified to enforce that rolling 24-hour limit and appears to reject a later check-in if any earlier check-in at that location exists. This discrepancy must be resolved before these terms are approved. Check-ins and stamps are subject to review for accuracy and misuse.

7. Trail requirements and changes

Each trail may have its own published locations and completion requirements. PerkTrek may change trails or requirements. For material changes, PerkTrek intends to provide reasonable notice and take reasonable steps to protect legitimate progress already earned. The application does not currently demonstrate a notice or progress protection process; this commitment requires an operational plan before these terms take effect.

8. Participating businesses

Businesses are independent participants that provide rewards and operate their own locations. PerkTrek provides the discovery and participation platform; it does not control a business's operations, products, services, staffing, or business decisions. Information about a business or location may change, and PerkTrek cannot guarantee a business's availability or performance.

9. Rewards and third-party offers

Rewards are supplied by participating businesses and may be subject to additional individual terms. Meeting the published trail requirements is necessary to qualify, but does not guarantee availability, acceptance, or a particular result. The terms disclosed for an individual reward govern its eligibility, redemption conditions, and expiration. Review the Rewards & Participation Policy for more information.

10. Fraud, review, and account action

PerkTrek may review activity that appears fraudulent, abusive, or inconsistent with these terms and may invalidate affected participation or reward claims, subject to applicable law. PerkTrek may restrict or suspend access when reasonably necessary to protect users, businesses, or the service. Specific review and appeal procedures have not been established in the application and require operational review.

11. Account suspension and termination

You may stop using PerkTrek at any time. Account deletion requests may initially be submitted by email to support@perktrek.com and will be reviewed and processed subject to applicable requirements. There is no in-app deletion feature or automatic deletion process identified in the current application.

12. Intellectual property

PerkTrek and its licensors retain rights in the PerkTrek service, branding, and materials, except for materials belonging to participating businesses or other third parties. These draft terms do not grant rights to use PerkTrek branding or materials beyond ordinary use of the service. Any required license scope should be confirmed by legal review.

13. Service availability

The service and its content may be changed, suspended, or unavailable from time to time. PerkTrek does not promise uninterrupted or error-free service, permanent availability of trails, or continued participation by any business.

14. Disclaimers and limitations

The specific disclaimers, warranties, and liability limitations applicable to PerkTrek require legal review. This draft does not attempt to waive non-waivable rights, establish an absolute exclusion of liability, or promise that rewards or business services will be available.

15. Disputes

If you have a concern about a check-in or reward, contact support@perktrek.com. PerkTrek reviews reported reward issues and may coordinate with a participating business, but no particular outcome is guaranteed. No mandatory arbitration, class-action waiver, or special dispute procedure is created by this draft. Any final dispute terms require legal review.

16. Governing law

PerkTrek LLC is based in Texas. The choice of governing law and any venue or jurisdiction provision for final terms must be reviewed and approved by counsel, including how applicable consumer protections apply. This draft does not select an exclusive forum.

17. Changes to these terms

PerkTrek may revise these terms as the service changes. Before approval, PerkTrek should determine how material changes will be communicated and when revised terms take effect. The approved version should include its effective date.
